Mediation in family cases - a failing service?

Over recent years, the Government has tried to promote mediation in divorce matters as a less stressful and less expensive publicly funded alternative to court proceedings. On 1 April 2013 legal aid was withdrawn for the majority of divorce proceedings.

Data compiled by the Ministry of Justice reveals that family courts referred just 713 parties to publicly funded mediation in 2013/14. This data suggests that the withdrawal of legal aid from solicitors for most family disputes has led to mediation numbers falling by almost 40% in the first full year of Government cuts.
