No fault divorce

By way of update, the Divorce, Dissolution and Separation Act 2020 came into force on 6 April 2022. The principle underlying the Act is that it will remove the 'blame game' which is widely acknowledged to have a significant negative impact on a couple and their children. Under the Act, one spouse (or the couple jointly) will be able to make a statement of irretrievable breakdown. It is not necessary to provide evidence of conduct or separation to prove irretrievable breakdown and the application can be made online.

Those considering a divorce may still wish to take specialist advice to assist with mediation or to deal with the post-divorce finances. It is important to understand that the new no-fault divorce procedure only relates to the divorce process itself. Dealing with division of assets, house, pension and income can often be the protracted, difficult part of the process.
